I presenti Termini e Condizioni (“Termini”) regolano il rapporto tra Rental4Kids S.r.l. (“Rental4Kids” o la “Piattaforma”), gli utilizzatori finali (“Utenti”), i partner (“Partner”) che intendono offrire servizi di noleggio attrezzature per bambini attraverso la piattaforma online www.rental4kids.com (“Piattaforma”). Il Partner accetta di essere vincolato dai presenti Termini.
Rental4kids è una piattaforma di intermediazione online dedicata al noleggio di attrezzature per bambini. Il Servizio consente agli utenti di ricercare, confrontare, prenotare e noleggiare prodotti.
Rental4kids consente l’incontro tra partner e utente finale. Rental4kids non è proprietaria delle attrezzature e non è fornitore diretto dei servizi di noleggio, non agisce come agente, mandatario o rappresentante del Partner
Il contratto di noleggio è concluso direttamente tra Utente e Partner.
2.1. Per diventare Partner, è necessario inviare richiesta di selezione tramite email a info@rental4kids.com fornendo informazioni accurate e complete.
2.2. L’adesione alla rete di Rental4Kids non è un diritto. Rental4Kids si riserva il diritto di selezionare i Partner in base a criteri di qualità, affidabilità e adeguatezza all’offerta della Piattaforma. Non vi è esclusività di Partner per ciascuna città.
3.1. Contenuto pubblicato
Il Partner concede a Rental4Kids il diritto di utilizzare tutto il materiale inviato per la creazione della propria pagina:
Il Partner certifica e garantisce di essere titolare dei diritti d’autore di foto/immagini o di essere stato autorizzato a utilizzare e caricare foto/immagini sulla piattaforma Rental4kids.
Il partner garantisce che tutto il materiale non contiene virus, materiale pornografico, illegale, osceno o inappropiato e non violino i diritti di terzi (diritti di proprietà intellettuale, copyright o privacy).
Tutte le foto/immagini/contenuti che non soddisfano i criteri sopra indicati non saranno pubblicati e/o potranno essere rimossi/cancellati/modificati da Rental4kids in qualsiasi momento e senza preavviso, e Babonbo si riserva il diritto di intraprendere azioni legali nei tuoi confronti per l’utilizzo o il caricamento di foto/immagini illegali o inappropriate sulla Piattaforma. La mancata rimozione o modifica da parte di Rental4kids delle foto/immagini/contenuti caricati sulla Piattaforma non sarà considerata come approvazione o accettazione della loro idoneità.
3.2 Qualità e Sicurezza dell’Attrezzatura.
Il Partner è l’unico responsabile di: sicurezza, pulizia, sanificazione, manutenzione e funzionamento di tutte le attrezzature che offre in noleggio attraverso la Piattaforma.
Il Partner è l’unico responsabile sulla conformità delle attrezzature alle normative applicabili (incluse norme UE e italiane) garantendo la presenza di certificazioni e di manuali di istruzioni.
Rental4Kids non ha alcuna responsabilità in merito a sicurezza, certificazioni e alla pulizia dell’attrezzatura fornita dal Partner.
3.3. Protezione dei minori.
Il Partner è responsabile di garantire che le attrezzature:

Il Partner si impegna a comunicare tempestivamente lo stato degli ordini ricevuti attraverso la Piattaforma, confermando o rifiutando la disponibilità dell’attrezzatura entro 24 ore.
3.5. Situazione Fiscale
Il Partner è pienamente responsabile della gestione della propria situazione fiscale. Dovrà:
Rental4Kids non fornisce alcuna consulenza fiscale e non è responsabile per la posizione fiscale del Partner.
3.6 Utilizzo dei dati dell’utente finale
È possibile trattare i dati personali dell’Utente esclusivamente per la fornitura dei Servizi tramite questa piattaforma e per nessun altro scopo, salvo che ciò sia necessario per l’adempimento di obblighi legali, fiscali o contabili.
3.7 Utilizzo del Logo
Il logo di Rental4Kids è proprietà intellettuale di Rental4kids di Silvia Sciuto e non può essere utilizzato in alcun modo, né per scopi promozionali né per altri fini, senza l’espressa autorizzazione scritta e concessa da Rental4Kids.
4.1. Rental4Kids agisce esclusivamente come intermediario per connettere le famiglie in viaggio con i Partner che noleggiano attrezzature per bambini.
4.2. Rental4Kids non assume alcuna responsabilità per:

5.1 Il Partner si impegna a manlevare e tenere indenne Rental4Kids da qualsiasi:

6.1 Il Partner fornisce alla Piattaforma il costo di noleggio giornaliero di ogni prodotto e i costi relativi alla consegna e ritiro dei prodotti, facendo riferimento a una guida sui prezzi fornita dalla Piattaforma, in relazione alle ricerche di mercato.
6.2 Il Partner paga un abbonamento annuale a Rental4kids come consulenza informatica fornita per la gestione della propria pagina sulla Piattaforma
6.3 Rental4kids non è parte del contratto di noleggio
8.1 Le politiche di cancellazione e rimborso dei noleggi ricevuti sono stabilite dal Partner attraverso la stipula di un contratto di noleggio tra il Partner e l’utente finale, salvo diversa indicazione della Piattaforma.
8.2 Rental4Kids non è responsabile per:
Rental4Kids può sospendere o terminare l’accesso del Partner alla piattaforma in caso di:
In questo caso, Rental4kids ti informerà per iscritto della sospensione del tuo account e della tua pagina.
Qualora Rental4kids ritenga che si possa rimediare, solo dopo aver risolto le motivazioni della sospensione, Rental4kids potrà ripristinare il tuo account e pagina sulla Piattaforma.
Rental4kids potrebbe anche decidere di interrompere la tua partecipazione alla Piattaforma in qualsiasi momento e senza preavviso.
Il trattamento dei dati personali avviene secondo la normativa applicabile (GDPR) e l’informativa privacy della piattaforma.
I presenti Termini e Condizioni sono regolati e interpretati in conformità con la legge italiana. Per qualsiasi controversia derivante dall’interpretazione, esecuzione o risoluzione dei presenti Termini, sarà competente in via esclusiva il Foro di Catania.
Rental4Kids si riserva il diritto di modificare i presenti Termini e Condizioni in qualsiasi momento. Le modifiche saranno comunicate ai Partner tramite la Piattaforma o via email. L’utilizzo continuativo della Piattaforma da parte del Partner dopo la comunicazione delle modifiche costituirà accettazione delle stesse.

These Terms and Conditions (“Terms”) govern the relationship between Rental4Kids S.r.l. (“Rental4Kids” or the “Platform”), the end users (“Users”) and the partners (“Partners”) who wish to offer children’s equipment rental services through the online platform www.rental4kids.com (the “Platform”). By joining the Platform, the Partner agrees to be bound by these Terms.
Rental4Kids is an online marketplace dedicated to the rental of children’s equipment. The Service enables users to search, compare, book, and rent products.
Rental4Kids facilitates connections between Partners and end users. Rental4Kids does not own any of the equipment listed on the Platform and is not the direct provider of rental services. Rental4Kids does not act as an agent, representative, intermediary, or authorised delegate of the Partner.
The rental agreement is entered into directly between the User and the Partner.
2.1 To become a Partner, applicants must submit a registration request by email to info@rental4kids.com, providing accurate and complete information.
2.2 Membership of the Rental4Kids network is not an entitlement. Rental4Kids reserves the right to select Partners based on quality, reliability, and suitability criteria in relation to the Platform’s offering. No exclusivity shall be granted to any Partner within a specific city or geographical area.
The Partner grants Rental4Kids the right to use all materials submitted for the creation of the Partner’s page, including:
Such materials may be used for the creation and publication of the Partner’s page on the Platform, as well as for promotional and operational purposes. The Partner shall provide all required materials within seven (7) days of receiving confirmation of selection.
The Partner represents and warrants that they own the copyright in any photographs or images submitted, or that they have obtained all necessary permissions to use and upload such content to the Rental4Kids Platform.
The Partner further warrants that all submitted materials are free from viruses and do not contain pornographic, illegal, obscene, or otherwise inappropriate content, nor infringe the rights of any third party, including intellectual property rights, copyrights, or privacy rights.
Any photographs, images, or content that do not comply with the above requirements shall not be published and may be removed, modified, or deleted by Rental4Kids at any time without prior notice. Rental4Kids reserves the right to take legal action against any person who uploads or uses unlawful or inappropriate content on the Platform.
Failure by Rental4Kids to remove or modify any content shall not be interpreted as approval or acceptance of its suitability.
The Partner shall be solely responsible for the safety, cleanliness, sanitisation, maintenance, and proper functioning of all equipment offered for rental through the Platform.
The Partner shall also be solely responsible for ensuring that all equipment complies with applicable laws and regulations, including Italian and European Union legislation, and that all required certifications and instruction manuals are available.
Rental4Kids accepts no responsibility whatsoever for the safety, certification, maintenance, or cleanliness of equipment supplied by the Partner.
The Partner is responsible for ensuring that all equipment:
The Partner agrees to promptly manage booking requests received through the Platform and must confirm or decline equipment availability within twenty-four (24) hours.
The Partner is solely responsible for managing their own tax affairs and shall:
Rental4Kids does not provide tax advice and accepts no responsibility for the Partner’s tax position.
Personal data relating to Users may only be processed for the purpose of providing services through the Platform and for no other purpose, except where required to comply with legal, tax, or accounting obligations.
The Rental4Kids logo is the intellectual property of Rental4Kids and may not be used in any manner, whether for promotional or other purposes, without the prior written consent of Rental4Kids.
4.1Rental4Kids acts solely as an intermediary connecting travelling families with Partners who provide children’s equipment rental services.
Rental4Kids shall not be liable for:
The quality, safety, cleanliness, or suitability of equipment supplied by the Partner;
Product defects, malfunctions, or non-conformities;
Incorrect information provided by Partners;
Personal injury or property damage;
Any dispute, claim, or loss arising from the use of rented equipment by end users;
Delays or failures in delivery or collection services;
The tax or legal status of Partners;
Interruptions to the Platform’s services, except in cases of wilful misconduct or gross negligence by Rental4Kids.
4.3 To the fullest extent permitted by law:

6.1 The Partner shall provide the Platform with the daily rental price for each product and the costs associated with delivery and collection services, taking into account the pricing guidelines supplied by the Platform and relevant market research.
6.2. The Partner pays an annual subscription to Rental4kids as IT consultancy provided for the management of its page on the Platform.
6.3 Rental4Kids is not a party to any rental agreement.
7.1 Cancellation and refund policies relating to rental bookings shall be determined by the Partner through the rental agreement entered into between the Partner and the end user, unless otherwise specified by the Platform.
7.2 Rental4Kids shall not be responsible for:
Rental4Kids may suspend or terminate a Partner’s access to the Platform in the event of:
In such cases, Rental4Kids will notify the Partner in writing of the suspension of their account and page.
Where Rental4Kids considers that the circumstances giving rise to the suspension can be remedied, access may be restored once the relevant issues have been fully resolved.
Rental4Kids also reserves the right to terminate a Partner’s participation in the Platform at any time and without prior notice.
Personal data shall be processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), and the Platform’s Privacy Policy.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Italy.
Any dispute arising out of or in connection with the interpretation, performance, or termination of these Terms shall be subject to the exclusive jurisdiction of the Court of Catania, Italy.
Rental4Kids reserves the right to amend these Terms and Conditions at any time.
Any amendments shall be communicated to Partners through the Platform or by email. Continued use of the Platform following notification of such amendments shall constitute acceptance of the updated Terms.
